How it applies
The 30-day deadline applies in two distinct scenarios:
1. Judicial recovery: After the approval of the plan or its conclusion, the judicial administrator must submit account statements for fee clearance (Art. 66, I).
2. Bankruptcy: After the conclusion of asset realization and distribution to creditors, the judicial administrator submits the accounts to the judge within the same deadline (Art. 154).
Limits
- The 30-day deadline does not apply to the submission of interim reports or partial accounts, which follow different deadlines as provided in Law 11.101/2005 (e.g., Art. 23, § 1º, for reports not submitted on time).
- Fee clearance depends not only on the submission of account statements but also on the approval of the report by the judge (Art. 66, I).
