Basis
- Decree No. 11.129/2022 (Planalto, in Portuguese): regulates Law 12.846/2013 and establishes PAR procedures, including deadlines for defense and legal entity manifestations.
How it applies
The 30-day deadline starts from the official date of notification of the indictment. The start day is excluded and the expiration day is included. If initial service fails, notification is made by public notice, with the 30-day deadline starting from the last publication date of the notice in the official gazette and the responsible body's website. If the defense is not filed on time, subsequent procedural deadlines run independently of new service.
Limits
- Deadline calculations follow the provisions of Chapter XVI of Law No. 9.784/1999.
- This sheet does not cover leniency agreement procedures or sanctions applied outside the PAR ritual under Decree 11.129/2022.
- Changes after the review date must be checked directly in the legislation in force published by Planalto.
